Terms of Service

These Terms of Service (“Terms”) govern your use of BeatThis, a mobile application (“the App”) operated by Charles Moreau, based in London, United Kingdom (“we”, “us”, “our”). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use BeatThis (16 in the European Economic Area, or the minimum age set by your country under Article 8 GDPR). By creating an account, you represent and warrant that you meet this requirement.

2. Your account

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Use a strong, unique password. Notify us immediately at support@beatthis.me if you suspect unauthorised access.

3. Acceptable use

You agree not to use the App to:

Harass, threaten, bully, stalk, or otherwise harm any person.
Post or share sexually explicit content, content depicting sexual exploitation of any person, or any content involving minors that is sexual, exploitative, or otherwise inappropriate.
Post content that is unlawful, defamatory, hateful, or that incites violence or discrimination on the basis of race, religion, ethnicity, national origin, gender, sexual orientation, disability, or any other protected characteristic.
Impersonate any other person or misrepresent your affiliation with any person or entity.
Post spam, advertising, or unsolicited promotional content.
Infringe any intellectual property, privacy, publicity, or other right of any third party.
Attempt to access another user’s account, the back-end systems, or any data you are not authorised to see.
Use the App to operate a commercial service or to collect data about other users.
Reverse engineer, decompile, or otherwise attempt to derive the source code of the App except to the extent permitted by applicable law.
Use automated means (bots, scrapers, crawlers) to interact with the App.
Circumvent any security or rate-limiting measure.

4. Your content

4.1 Ownership

You retain ownership of the photos, videos, captions, comments, and other content you submit to the App (“Your Content”).

4.2 Licence you grant us

By submitting content to the App, you grant BeatThis a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, distribute, and otherwise process Your Content solely for the purpose of operating, providing, and improving the App and showing your content to the members of the group(s) you have joined. This licence terminates when you delete the content from the App or delete your account, except where we are legally required to retain copies (e.g., to comply with a lawful request from an authority) or where the content has been re-shared by other users outside of the App.

4.3 Your responsibility

You represent and warrant that (a) you own or have all necessary rights to share Your Content, (b) Your Content does not infringe any third-party right, and (c) Your Content complies with these Terms.

4.4 Moderation

The App provides tools for users to block other users and report content. We review reports and may, at our sole discretion, remove content, suspend, or terminate accounts that violate these Terms. We are not obliged to monitor content but reserve the right to do so.

5. Push notifications

The App may send push notifications to your device about activity in your groups (a new challenge, a new submission, a rating, a comment). Notifications are entirely optional and can be disabled at any time from your device’s system settings.

6. Service availability

We provide the App on an “as is” and “as available” basis. We do not guarantee that the App will be uninterrupted, error-free, secure, or always available. We may change, suspend, or discontinue any part of the App at any time without notice.

7. Termination

You may delete your account at any time from Settings → Delete account. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or if we are required to do so by law. On termination, the rights granted to you under these Terms cease immediately; Sections 4.2 (to the extent of any sub-licences already granted), 8, 9, 10, 11, and 12 survive.

8. Disclaimers

To the maximum extent permitted by law, the App is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty regarding the accuracy, reliability, or availability of any user content.

9. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the App. Our aggregate liability for any direct damages will not exceed the greater of (a) the amount you have paid us in the twelve months preceding the event giving rise to the claim, or (b) GBP 50. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim or demand made by a third party arising out of (a) Your Content, (b) your use of the App, or (c) your breach of these Terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms or the App will be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers may also bring proceedings in the courts of their country of residence as required by applicable law.

12. Miscellaneous

Entire agreement. These Terms and the Privacy Policy form the complete agreement between you and us regarding the App.
Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
No waiver. Our failure to enforce a right is not a waiver of that right.
Assignment. You may not assign your rights under these Terms; we may assign ours.

13. Changes

We may update these Terms from time to time. When we make material changes, we will notify you in the App and update the “Effective” date above. Continued use of the App after a change indicates your acceptance of the updated Terms.
